This article reviews recent advances in the study of the European Court of Justice (ECJ) and its political impact at the European and member state levels. New quantitative as well as qualitative analyses show with great empirical precision that member state preferences guide the Court. The article summarises these findings, but argues that greater attention needs to be given to the (over-)constitutionalisation of EU law in order to fully capture the political impact of ECJ jurisprudence. Even if European judges are less activist than is often assumed and individual decisions are more restrained in the face of member state opposition, incrementally, case law evolves in a highly expansive fashion. And, exercising caution regarding unrealistic expectations about quasi-deterministic judicial law-making, it is found that the Court’s constitutionalised jurisprudence impacts heavily on European and member state policy-making. 相似文献

AbstractThis paper compares the reasons given by three South-east Asian states (Laos, Thailand and Vietnam) for choosing to suppress opium production. While external pressure, often from the US or United Nations (UN)/League of Nations, is the most commonly identified reason in the literature, and was experienced in each case, it was not by itself sufficient to motivate states into action. All three cases were motivated by religious or ideological opposition to drug consumption or trade, rural development, state extension and concern for increasing domestic drug consumption. Apprehension about rising drug consumption often possessed racial or chauvinistic elements. The development of export commodities, environmental protection and national security were also identified in one or two cases. The paper concludes by hypothesising that economic and/or security considerations underlie all choices to suppress illicit drug crops. 相似文献

AbstractIran has pursued a highly contradictory policy towards Afghanistan. On the one hand, it became a significant beneficiary of the overthrow of the Taliban regime by the US-led military intervention in 2001 in Afghanistan. The new Afghan government established cordial ties with Iran, allowing it to expand its political, economic and cultural influence in the country. Yet Iran has also provided significant support to the Taliban in its campaign to violently upend the political, social and economic processes in the country. This article examines the underlying domestic and regional security dynamics that contribute to this contradictory behaviour. It offers an assessment of how tensions between the United States and the Islamic Republic, as well as Tehran’s growing threat perception following the rise of the Islamic State – Khorasan in 2014, impact on Iran’s policy towards the Taliban. The paper argues that Tehran views the Taliban as an instrument to disrupt the influence of other actors in Afghanistan. The instrumentalisation of the Taliban, however, is likely to be counterproductive for Iranian security in the long run as it contributes to Afghanistan’s instability and insecurity and undermines Iran’s own long-term interests. 相似文献

This article explores the construction of extremism in media discourse, the factors driving specific constructions and the implications of these constructions for counterterrorism policy. We contend that extremism has predominantly and increasingly been framed as a security issue. This article explores the implications of this practice through the framework of securitisation. We measure the average intensity of security framing in 38,616 articles found in three major US newspapers, New York Times, Wall Street Journal and Los Angeles Times, between 20 January 1993 and 19 January 2017 comprising the Clinton, Bush and Obama presidencies, and look at factors influencing the shift in intensity over time. Through our analysis, we show that it is possible to return to a pre-9/11 discourse but that the confluence of real-world events and the strategic choices of political actors have so far prevented this from fully occurring. We then explore the effect of securitisation on public perceptions of the threat from terrorism, finding that increases in the intensity of security framing artificially increases the public’s worry about becoming a victim of terrorism. We conclude by discussing implications for the communication of counterterrorism policy and the requirements for an after, after 9/11 approach 相似文献

ABSTRACTWhy did some European countries choose migrant labour to expand their labour force in the decades that followed World War II, while others opted for measures to expand female employment via welfare expansion? The paper argues that gender norms and the political strength of the left were important structuring factors in these choices. Female employment required a substantial expansion of state intervention (e.g. childcare; paid maternity leave). Meanwhile, migrant recruitment required minimal public investments, at least in the short term, and preserved traditional gender roles. Using the contrasting cases of Sweden and Switzerland, the article argues that the combination of a weak left (labour unions and social democratic parties) and conservative gender norms fostered the massive expansion of foreign labour and a late development of female labour force participation in Switzerland. In contrast, more progressive gender norms and a strong labour movement put an early end to guest worker programmes in Sweden, and paved the way for policies to promote female labour force participation. 相似文献

AbstractThe goal of this special issue is to highlight the importance of unconventional social policies, theorize their development in comparison with traditional welfare state accounts and outline a new research agenda. In this introduction to the special issue, the editors present the concept of social policy by other means as encompassing two kinds of unconventional social policy (from the point of view of mainstream comparative research): First, functional equivalents to formal systems of social protection and, second, non-state provision of benefits. The concept builds upon a sizeable, but fragmented literature in comparative welfare state research. While numerous examples demonstrate that social policy by other means is more pervasive in both OECD and non-OECD countries than often acknowledged, a brief survey of the top 20 articles in the field reveals that this fact is not sufficiently reflected in the academic literature. With reference to both existing studies and the contributions to this special issue, the editors go on to explore (1) the different forms of social policy by other means, (2) explanatory theories and (3) their effectiveness in terms of social outcomes. The role of civil society organizations (CSOs) as a watchdog in the implementation process is widely acknowledged. However, little is known about what determines their capacity to monitor EU policy implementation and how it differs across member states. This article accounts for social capital as well as human and financial capital to determine the monitoring capacity of CSOs. To capture sources of social capital, a network analysis is applied in a comparative case article on the monitoring networks of national platforms of the European Women’s Lobby across eight EU member states. The analysis reveals that CSOs in western member states are rich in human, financial and social capital, while CSOs in CEE member states compensate for this lack of resources by linking up with the Commission. 相似文献

After the 2008 global financial crisis, both the United States and the United Kingdom introduced austerity policies targeted at particular elements of their national budgets. The purpose of this article is to compare the nature of this retrenchment; the similarities and differences in how it was implemented; and its initial impacts on one of the expenditure areas particularly affected: affordable rental housing programs and housing support for low-income households. Using a wide range of data sources, we find evidence of political and fiscal policy analogies in the timing and forms of the initial policy choices and how these were modified in the face of economic and political pressures. There are considerable similarities both in the instruments used to reduce housing expenditures and in the early impacts on support mechanisms and recipients. However, we find different histories and trajectories of support between the two countries that suggest that the longer term differences in outcomes may be more important. 相似文献

While public opinion about foreign policy has been studied extensively in the United States, there is less systematic research of foreign policy opinions in other countries. Given that public opinion about international affairs affects who gets elected in democracies and then constrains the foreign policies available to leaders once elected, both comparative politics and international relations scholarship benefit from more systematic investigation of foreign policy attitudes outside the United States. Using new data, this article presents a common set of core constructs structuring both American and European attitudes about foreign policy. Surveys conducted in four countries (the United States, the United Kingdom, France and Germany) provide an expanded set of foreign policy‐related survey items that are analysed using exploratory structural equation modeling (ESEM). Measurement equivalence is specifically tested and a common four‐factor structure that fits the data in all four countries is found. Consequently, valid, direct comparisons of the foreign policy preferences of four world powers are made. In the process, the four‐factor model confirms and expands previous work on the structure of foreign policy attitudes. The article also demonstrates the capability of ESEM in testing the dimensionality and cross‐national equivalence of social science concepts. 相似文献
